Boston-WTO Protesters Arraignment Tomorrow! (english)

Tomorrow morning, 4 protesters arrested at the Boston anti-WTO rally-march from Saturday September 13 will be arraigned. The 2 minors arrested were arraigned this morning.

As it stands right now we are being charged with Disorderly Conduct and Disturbing the Peace but have reason to believe they may try to levy heavier and more ludicrous charges against us when we arrive.

The hearing takes place at 8:30am at the Post Office Square Courthouse.

More updates will be posted as we learn more.

If you were there, we are looking for two things:

(1) statements from witnesses of the arrest and the entire incident. needs: date-time-location-your full name-current phone number

(2) any recording of the arrest-shaws incident. i.e. video or photo.

NOTE: Do Not Post Video-Photos to indymedia or any other site. Doing so could needlessly endanger the legal standing of those arrested.

I just wanted to let you all know that the charges against you are Bullshit

First of all, because I was there and saw no reason for arrsts

and second, because of a precedent set in 1989 in the case of the commonwealth v. Joel Feigenbaum. To paraphrase the precedent is is sufficient to state that in Mass. you CANNOT be charged with disorderly conduct if you are participating in a political act. In the decision of the Feigenbaum case it was pointed out that he may have been engaged in some other criminal act, but the charge of disorderly conduct will not hold up.

Chapter 272: Section 53 Penalty for certain offenses

Section 53. Common night walkers, common street walkers, both male and female, common railers and brawlers, persons who with offensive and disorderly acts or language accost or annoy persons of the opposite sex, lewd, wanton and lascivious persons in speech or behavior, idle and disorderly persons, disturbers of the peace, keepers of noisy and disorderly houses, and persons guilty of indecent exposure may be punished by imprisonment in a jail or house of correction for not more than six months, or by a fine of not more than two hundred dollars, or by both such fine and imprisonment.
