Timoney Three Acquited

Camilo Vivieros and the Timoney Three were acquited of all charges placed against them by the City of Philadelphia today, Tuesday, April 6th. It was the second day of a trial that had been stalled for over three years.

Camilo Vivieros and the Timoney Three were acquited of all charges placed against them by the City of Philadelphia today, Tuesday, April 6th. It was the second day of a trial that had been stalled for over three years.

Katie Krauss, a representative of the R2K Legal Collective, a group which has been working to represent and support individuals accused of crimes while exercising their right to demonstrate, said on the acquitals, "These acquitials are another vindication of the hundreds and hundreds of protetsers who were rounded up and kept off the streets during the Republican Convension of 2000, and another blow to police chief timoneys grab bag of tactics against legal, non-violent demonstrators."

Testimony Tuesday was scheduled to focus on personal accounts from John Timoney, who had accused Vivieros and his codefendants, Darby Landy and Eric Steinberg, of property damage and assaulting police officers. Krauss reported that Police Commissioner Timoney was unable to remember much about the incident where the supposed assault occurred in 2000. He couldn't remember the exact street intersection where the supposed event occured, and kept his testimony very general, she reported.

Krauss also reported that the prosecution rested today, and the defense presented their arguments. The room was filled with character witnesses for the defendants, and the judge read off their names and acknowledged them one by one. There was also a moment when the many letters of support the defendants received were entered into the record as an exhibit.

In a perfect world RNC2000 demonstrator Camilo Viveiros would be free and former Philadelphia police chief John Timoney would be doing ten years community service on peaceful conflict resolution. Well, it’s not a perfect world, but Camille is free.

Viveiros was busted during the Repugnican national convention in the year 2000 for allegedly throwing a bicycle at Chief Timoney. However, in the early stages of the trial for the Timoney 3, Judge William J. Mazzola acquitted Viveiros, along with Darby Landy, and Eric Steinberg of all charges after being presented with a videotape of the incident. As defense lawyers noted, the tape showed Viveiros, acted peacefully when assaulted by police, in spite of testimony by cops that he had resisted arrest. Apparently unwilling to believe their eyes, Philly prosecutors said the tape was “inconclusive”. Sorry guys, the frame-up is over.

My friend Camille (there’s two ways to spell his name) and his co-defendants have had to endure four years of legal wrangling and the expense of time, money and energy fending off the belligerent actions of Timoney and the vindictive apparatus of the Philly PD. These are the same people who framed Mumia abu Jamal; the same police chief who created a police state in Miami during the recent FTAA demonstrations and inspired the forces under him to viciously assault innocent protestors and passers-by while making a complete mockery of civil rights. In short, John Timoney isn’t a very nice guy.

Yet, while Timoney is a complete asshole, Camille, on the other hand, is one of the sweetest guys you could ever hope to meet. We all celebrate Camille’s new found freedom and applauded him when he said upon hearing the judges verdict that he was looking forward to peacefully demonstrating at the 2004 Republican National Convention in New York. We are looking forward to that event as well and being in the streets with Camille and thousands of other concerned U.S. citizens sending the message, loud and clear, that the Bush regime must go; that they and their neo-con minions are not welcome in New York, not welcome in the Northeast. Viva Viveiros!
