Coalition Against Election Fraud Urges Senators Not to Certify Illegal Electoral Votes
06 Jan 2005
Seeking at least one U.S. Senator to take a stand on January 6 against illegal electoral votes, ten local activists with the Coalition Against Election Fraud (CAEF) headed to Washington D.C. on Tuesday to meet with Senators on Capitol Hill. Coalition members also braved the snow today as they continued their vigil outside of Senator John Kerry’s Boston home and met with an aide at Senator Edward Kennedy’s Boston office to plead their case.

“DO NOT CERTIFY ILLEGAL ELECTORAL VOTES”
– LOCAL ACTIVISTS URGE U.S. SENATORS

Also today, Rep. John Conyers, the Ranking Democrat on the House Judiciary Committee, released a report of results of the Committee’s investigation into irregularities reported in the Ohio presidential election. Timed to precede tomorrow’s Joint Meeting of Congress to consider the votes of the electoral college for president, the report states that “there are ample grounds for challenging the electors from the State of Ohio,” and recommends that Congress investigate further the “widespread irregularities reported in Ohio.”
While in D.C. Coalition members are lobbying a national list of Senators, including Kennedy and Kerry, to join with members of the House who have announced that they plan to challenge the seating of electors from states such as Ohio, where election results are still in question due to widely documented fraud and vote suppression. Conyers and Rep. Maxine Waters, D-Calif, have both stated their intentions to challenge the seating of the Ohio electors.
On Monday night, a crowd of about 300 gathered at a CAEF rally at Faneuil Hall to hear firsthand accounts of election fraud and voter suppression in Ohio and Florida. Speakers told of African-Americans being routinely turned away from the polls, threats and assaults on campaign workers, polling places changed at the last minute, and misinformation telling voters that Democrats were to vote on Wednesday, the day after election day. Electors from Massachusetts and Vermont, as well as attorneys with expertise on voting rights issues cited mounting evidence of fraudulent vote counts from electronic voting machines, the lack of paper records, and inequities in the number of voting machines available at highly Democratic polling places, among other reasons that the electoral vote should not be certified on Thursday. Speeches were met with several standing ovations at the rally, which lasted over three hours.
“Ohio has not yet had a meaningful recount,” stated Boston voting rights attorney John Bonifaz, who spoke at Monday night’s rally. Bonifaz, who is representing Presidential Candidates David Cobb and Michael Badnarik in their legal request for an Ohio recount, has petitioned the court for a new recount in Ohio due to non-compliance with state and federal laws by Ohio officials in the first recount. Therefore, Ohio Secretary of State Kenneth Blackwell had “no right to appoint a slate of electors in Ohio and Congress has no right to certify the electoral vote until all the votes are counted in Ohio in accordance with state and federal laws,” according to Bonifaz.

Also speaking at Monday’s rally, David Lytel, founder of RedefeatBush.com and a leader in the nationwide electoral challenge movement, stated: "We do not have to suffer another four years of an illegitimate presidency since the Consti-tution and Federal law set out how to challenge unlawfully acquired electoral votes." Lytel explained that there are laws mandating specific penalties be invoked by Congress if the right to vote is 'in any way abridged.'”

"There are considerably more reported cases of vote suppression, fraudulent vote casting and fraudulent vote counting than George W. Bush¹s margin of victory in Ohio and Florida," Lytel continued. “There is overwhelming evidence that the misadministration of the election was non-random. It is literally impossible that chance could produce errors that all point in the same direction, giving votes to Bush."

Jonathan Simon, a local activist and attorney, described how he closely watched the exit polls on election night, saving on his computer all of the final exit poll results. “These results were later changed to match the official vote count,” according to Simon. He shared this data with U. Penn. Professor Steven Freeman, who worked with Simon on publishing an analysis of the discrepancy between actual exit poll data and the “official” election results.

The media has implied that alleged fraud in the 2004 election amounts to “merely random 'glitches' or 'irregularities' and that the only recourse is to fix the system in time for the next election," according to Lytel, who is quick to add, "they are wrong on both counts... The misadministration of the election was deliberate and purposeful and we have
more than one course of action to return the nation to the proper path right now.”
