Discimination By A Court Of Law
28 Oct 2001

Brief explanation of how my brother in trying to be a hardworking, loving family man became instead a subject of racial and ethnic bias all in the name of justice.
Even though I am physically miles away from my only brother who lives in Mass. but we have never been closer in all our years. Just like the horrible events of the 9/11 has brought many people and families closer together, so has what has happened to my brother with an eery parallel of occuring on 9/14.
My family migrated to the United States from Iran some 22 years ago to accopmany my mother who had a scholarship to pursue a masters degree at the University of Oklahoma in Norman, Oklahoma. As my brother and I grew up in Oklahoma, he fell in love and married his college sweetheart right after college, she seemed so in love that even a long difficult last name such as Foroughirad didn't deter her from wanting to be calle Mrs.F. Well, that was 17 years ago, about 2 years ago while he was sent away to Japan by his now former employer, she decided he wasn't good enough for her and that all along she had preferred an American man. Well, in short, they got a divorce, went through all the usual fights, and settled on visitations and child support. All that changed when my brother was laid off after 7 years, this put a new strain on the already tired battle and just as my brother was walking into the courtroom in family and probate court in Middlesex county for a hearing on a possible reduction of his child support payments, he was ordered by the presiding judge, Ginsburg to be put in jail. This was not the first time he was sent to jail, that first time had happened on 9/14 with the ominous words form the judge's mouth, with all these happenings, I'm putting you in jail for your own good. Does that mean my brother is being looked at as a possible terrorist because of his olive complexion, or is it becuase of his Iranian background with a name like Atilla Foroughirad? If it is not bias, what could be motivating a judge who is suppose to uphold the law to disregard the law and justice and hold himself above it all? Why would this happen to my brother at precisely this time? Why the 14th and not the 5th of September, clearly he has been going back and forth to the same court adn the same judge for the past 2 years.
I say this is racial profiling and it couldn't have happened to a nicer, more easy going man who is loved by his family and his 3 lovely children despite what any court may rule.

Okay, so what was the judge's stated reason?

Being sent to jail is a scary, ugly thing to have happen. But the judge had to justify it in some way, regardless of the truth of the matter. So what was his justification? Did your brother say something that was misinterpreted? What happened? You haven't given us enough information.
