Nick Giannone, the last of the three DNC defendants, was acquitted today. He was charged with assaulting BPD superintendent Dunford.

I'm as happy as anyone that Nick was aquitted, but, you know, the cops were probably expecting that. It's increasingly common for police to arrest protesters on charges they know won't stand up in court--it's a method of crowd control (keep people from doing anything disruptive and therefore potentially effective by arresting them before they do it) and it ties activists up in court, giving them less time to work on movement-building and costing them money.

The question then becomes, is there anything we can do to keep cops from using this illegal strategy (knowingly engaging in false arrest)? Since what they're doing is already illegal, I don't think a court ruling on this sort of thing would do much good--and the government's not exactly going to clamp down on the cops in this atmosphere.

I was literally ten feet away during the arrest. Its good to hear all ended well, just too bad there was so much crap in the middle.

If it did he would not have been arrested in the first place and spent a year of his life and a good deal of money he didnt have trying to get justice, which the police are careless with and dont give a shit about. Arrest first and figure out a charge later is not a good justice system.

Well he did have a confrontation with the police, it's not he was scooped up for absolutely no reason. Before you ask the question, yes I was there. I was covering the story for an "alternative news" outlet. Rememeber, when you deal with police in the real world, they only need probable cause, not absolute certainty that an incident occured. Probable cause is a very vague legal concept. He was up in the cop's face, displaying behavior that COULD have been interpetted as an assault. Dealing with the police is not like dealing with mommie and daddy..

I wasn't at the protest, so i'm not going to say anything about whether or not Nick was "in the wrong."

However, after seeing the BPD protecting Billy Roper & crew, I'm not too keen on their behavior. And you can feed me the line about "Freedom of Speech", but it's a simple matter of which direction the pigs face.

Unfortunately, even people like Roper have rights. He (they) can say whatever he wants as along as doesn't act on it. I much as a I disagree with Roper's view, I think it's dangerous to silence an opposing view no matter how vile you think it is. As far as the cops go, of course they are going to face the people oposing Ropers crew. Ropers "people" want to be attacked to further their "cause". The counter protesters were just feeding into Ropers plans, so if you look at that way, is his mind, Roper won.

What about phelps in Brookline, Lexington, Milford? Army's birthday at Cambridge Common? Boston salutes Israel day? Which direction did the cops face at each of those events and what does that say about the cops?
